  Phony Benoni: Under current rules, either side had a chance to claim a triple repetition of position; Black before playing 45...Rg2, or White before playing 46.Re2.

In the Soviet Union in 1934, the rules may have been different. For instance, if the rule stated that the same sequence of moves must be repeated three times, a repetition would not exist here since Black's first move in the sequence was ...Rg6-g2, not ...Rg1-g2.
