i suppose he could have, but it would have been extremely premature, since black had a perfectly playable endgame with 2 pieces for a rook and 2 pawns, and white has no immediate threats or even a single passed pawn. black's mistakes on moves 36 and 37 cost him the game however. 36...Nxe5 and there is no win in site for white.
