Chessgames Services LLC (the "Company") hosts and operates Chessgames.com (the "Site") on the Internet. By becoming a registered member of Chessgames.com and using its services, I agree to abide by all Chessgames policies, whether explicitly written, or unwritten but established by common practice, and the terms and conditions set forth in this User Agreement, which may be revised by the Company from time to time.

In using the Chessgames.com Site I hereby agree:

1. I will not give my password to anyone. I will not share my account. I am the only person allowed to use my account. I will not use any account which does not belong to me.
2. I will behave decently toward other users, and when posting messages on the Site I will abide by the published posting policies. I acknowledge that violation of these policies may result in my membership privileges being suspended or revoked, without refund.
3. I will not copy, or in anyway display, reproduce, distribute, modify, or transmit the contents of the Site without prior written permission of the Company.
4. I will not use the Site for commercial purposes. I will not use the Site for advertising of any sort without prior written permission of the Company.
5. I understand that my premium membership is non-transferable. I alone will use my premium account, and I cannot give the time on my account to any other person.
6. I understand that even if only a fraction of my premium membership time is used, I am not eligible for a refund on the unused portion.
7. I understand that information voluntarily contributed to the Site--including but not limited to messages posted to various pages ("kibitzes")--cannot be deleted except by normal site functions.
8. I understand that my account, its name, its messages posted to various pages ("kibitzes"), its game collections, etc., may be archived indefinitely even if I stop visiting the Site.
9. The opinions expressed by Site members are not necessarily those of the Company. The Company is not responsible for any communications posted by its members.
10. If a representative of the Company has reason to believe that I have violated the Site's policies or any term or condition of this User Agreement, I acknowledge and agree that such representative has the right to take appropriate actions in his/her sole discretion, including without limitation, temporary suspension of services, or in extreme cases, a permanent loss of my membership to the Site without any refund.
11. I have neither the ability nor the right to remove my kibitzing or account from Chessgames, except as the software allows.
12. THE CHESSGAMES.COM SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY, THE WARRANTY OF NON-INFRINGEMENT OF THIRD PARTY RIGHTS AND THE WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY DOES NOT WARRANT THAT THIS SITE WILL OPERATE ERROR-FREE OR WITHOUT INTERRUPTION. IF THE USE OF THIS SITE OR ITS CONTENT RESULTS IN THE NEED FOR REPLACING OR SERVICING MY COMPUTER EQUIPMENT, SOFTWARE, DATA OR OTHER PROPERTY, THE COMPANY IS NOT RESPONSIBLE FOR THESE COSTS.
13. IN NO EVENT SHALL THE COMPANY, ITS OFFICERS OR DIRECTORS, EMPLOYEES AND AGENTS, BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES RESULTING FROM THE USE OR INABILITY TO USE THE SITE AND ITS MATERIALS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES).
14. The Company has the exclusive right, title and interest to the contents of Site, including without limitation, the Company's trademark, service marks, copyrights and other intellectual property (the "Proprietary Rights"), unless otherwise specified therein.
