After <42...Ke8 43.Qb8+ Kd7 44.Qa7+ Ke6 45.Qb6+ Kf5>, the Black king escapes and Black wins. But you're right in that White did have a perpetual after 41.Rxd8+, <41...Kxd8 42.Qf8+ Kd7 43.Qxf7+ Kd6 44.Qxf6+> being one line.
