Dec-21-11  matebay: If you ask me boss, I say <AJ>'s actions here is an exercise of complete self defense. The following ruling would apply:

When a person is libeled, he may hit back with another libel, which, if adequate, will be justified. Once the aspersion is cast, its sting clings and the one thus defamed may avail himself of all necessary means to shake it off. (People v. Chua Hong, 51 OG 1932)

http://attyrcd.wordpress.com/2010/0...

Dec-21-11  matebay: It would seem also that the accusers here are more guilty of the commission of an offense more than <AJ>. They are the ones that need to be prosecuted. Please refer back to their posts for incriminating evidence which you can use against them.
Dec-21-11  brankat: The uncalled-for attack on Dr.Eric Schiller was a serious blunder. Game lost.
Dec-21-11  matebay: Boss, it would also appear that their complaint lack the sufficiency of form and substance as follows:

<Sufficiency Of Complaint Or Information

Sec. 6. Sufficiency of complaint or information. – A complaint or information is sufficient if it states the name of the accused; the designation of the offense given by the statute; the acts or omissions complained of as constituting the offense; the name of the offended party; the approximate date of the commission of the offense; and the place where the offense was committed.

When an offense is committed by more than one person, all of them shall be included in the complaint or information.

WHEN IS A COMPLAINT OR INFORMATION DEEMED SUFFICIENT? It is deemed sufficient if it states the following: o The name of the accused
o The designation of the offense as defined by statute o The acts or omissions complained of as constituting the offense o The name of the offended party
o The approximate date of the commission of the offense o The place of the commission of the offense

WHAT IS THE RATIONALE BEHIND THE REQUIREMENTS TO DEEM A COMPLAINT OR INFORMATION TO BE SUFFICIENT? This is in consonance with the accused’s right to be informed of the nature and cause of the accusation against him.>

Unless and until they comply with the requirements, their unfounded accusations must be rightfully thrown out of the window.

Dec-21-11  matebay: As <AJ>'s counsel, I rest my case. Hey Boss your turn...decision please.
Dec-21-11  matebay: Hey <twinlark>...Kindly tell CG to come up with a decision on the <AJ> bashing. It seems CG only listens to you.

Domdaniel: <matebay> This page is intended to notify CG about problems.

You seem to have had eleven or twelve of these today alone.

Is there smoke coming out of your computer?

Dec-21-11  brankat: It's not the computer, but rather the brain.
Dec-21-11  TheFocus: To ALL Members: I am not <Eric Schiller> which anyone with an ounce of brains would know. <Eric> has been unable to post much in the last few months due to his being in the hospital. Whereas, I have been posting almost every day.

<TheFocus> is made up of two people. Akiva Berlinski and Nikolai Brunni.

Daniel, you have our public permission to verify that this account is paid for by Nikolai Brunni.

I make the majority of the posts here. Mr. Brunni writes the poems, stories, and jokes and is a minor chess historian who has helped other authors with their books. He has written newspaper and magazine articles and has made several posts to Edward Winter's <Chess Notes>.

We will not stand aside and allow <Eric Schiller> to be attacked in this way. This attack cannot be allowed to go unpunished. You are quick to ban other people or even limit their posting when they have done wrong. Do it here!

Dec-21-11  brankat: Well done <TheFocus>!
Dec-21-11  TheFocus: A lot of people made some very nice posts regarding <Eric Schiller>.

BRAVO to you all.

Dec-21-11  benjinathan: <Well done <TheFocus>!><

Well done <The Focuses>!

Dec-21-11  matebay: <Domdaniel: <matebay> This page is intended to notify CG about problems.>

All cases without decision is a clogged docket

It's like a thousand police blotters without arrests made...meanwhile, criminals go scot-free and peace loving citizens terrorized and disturbed from their normal routines.

CG needs to act on important issues fast...else the CG world will keep on singing the same old refrain.

Dec-21-11  TheFocus: I notice that <AJ> did not post his attack on <Eric Schiller> on his own Forum.

Maybe he did not want his "fans" to see how despicable he acts.

Nor did he post it at my Forum either.

Dec-21-11  TheFocus: Of course, he was too cowardly to post it on <Eric Schiller>'s page either.
Dec-21-11  matebay: <We will not stand aside and allow <Eric Schiller> to be attacked in this way. This attack cannot be allowed to go unpunished.>

Maybe he attacked <AJ> first. AJ at the receiving end has always been the norm. <AJ> only retaliated after the sufficient provocation. In such a case, it is an exercise of self defense. AJ absolved from any civil and criminal liability...E.S will be the one to face prosecution...

All pertinent facts must be presented. Discriminatory posting of facts is a form of misrepresentation.

Dec-21-11  TheFocus: <matebay> Please show us just ONE insult hurled at <AJ> by <Eric Schiller>.

Just one. You are a loser just like <AJ> is.

Dec-21-11  matebay: You are the accuser here. You must first show one insult hurled by AJ to ES. Then <AJ> gives his rebuttal...Only at that time will AJ reveal his evidence that he is a victim of a vicious attack. That his response was only in self defense, hence fully excusable.
Dec-21-11  Nemesistic: I also totally agree with <tpstar>..

Maybe now, with the end of the year only days away it would be a good time to put a stop to the Goldsby problem once and for all,by banning him for good??

Start the new year Goldsby free?

And this latest attack on Eric Schiller is beyond ridiculous..

Dec-21-11  TheFocus: <Eric Schiller>, may I ask you a question? What do you think about <AJ Goldsby>'s attack on you?

<Eric>: AJ Who?

Well, he's a Life Master from Pepsicola, Florida.

<Eric>: What's a Life Master?

FSR: <Dom> <The Big Book of Busts> by John Watson and Eric Schiller is a great book. It has nothing to do with women's anatomy, Dom. Get your mind out of the gutter. I believe that several later editions have been published, with titles like <Beating Unusual Chess Openings> and <How to Survive and Beat Annoying Chess Openings>.
Dec-21-11  King Death: <FSR> The Big Book Of Busts? There is such a book? That's great!

FSR: I entered "Chicago, Illinois" into Tim Hortons' store locator. It identified a gas station in Hobart, NY, which it says is just 31.2 miles from Chicago! http://www.timhortons.com/us/locato... I'll have to visit New York a lot more often.
Dec-21-11  King Death: <FSR> That's a funny typo. I'm just trying to figure out how somebody came up with "NY" for "IN". It's way above my head.

OK. I thought <The Big Book of Busts> would have marble statues of the heads of Caesar and Cicero.
