  FSR: <perfidious> I have never encountered anyone named "Killer" before. (My daughter once had a soccer coach who went by "Chuck Manson." Presumably "Chuck" is a diminutive for his actual first name. Shades of the "Joel Rifkin" Seinfeld episode.) I have occasionally wondered about situations where someone named, say, "Slaughter" is charged with murder or manslaughter. Maybe it sounds silly, but I would think the mere name would have to prejudice the jury. Were I representing the defendant, I would file a motion in limine asking that the prosecutor refer to my client before the jury as "the defendant" rather than "Slaughter." I can imagine a zealous prosecutor repeatedly using the defendant's surname to try to bias the jury. Incidentally, when representing the City of Chicago, I had a case where the City had fired a man named "Archie High" after he failed a drug test. With difficulty, I resisted the temptation to make some wisecrack about his name in my brief or at oral argument.

Not hard to envision a prosecutor trying that angle, or the potential effect it might have, even if the prosecuting attorney used it the one time and was given an admonition to not use the name for the duration of the trial by the presiding judge.

As to 'Archie High', in your shoes, I would have managed to avoid a smartass remark, but only through a superhuman effort, given my sense of humour.
