Appears to me that may be illegal, but as usually the case a "fair use" disclaimer is being put in the description, and that's it. Or is it? Apparantly, there often is, and forgive me but this is all relatively new to me. But it's very important. To know to what extent and in what clipped or edited form creative musical art from the recent past can be used in not-for-profit info documentaries. |

In YouTube’s CIS Fair Use Q&A video, Julie Ahrens debunks some common myths about fair use.Myth #1: If you are making money off a video using copyrighted content, this is not fair use. Reality: Ahrens says that whether or not something is used for commercial purposes is not a factor that goes into deciding whether it is fair use or not. She says that there are many commercial enterprises that actually rely on fair use. So if you are creating commercial work, for profit, you can use copyrighted content as long as it falls under fair use. Myth #2: As long as you give credit to the original creator then you won’t be liable for copyright infringement. Reality: You are not required by law to give credit when using another person’s work under fair use and, by the same token, crediting someone will not protect you from copyright infringement. That being said, it is often advised to give credit when using someone else’s content. It just may help you avoid a lawsuit and sometimes all that the original creator wants is credit for his or her work. Myth #3: If I use less than thirty seconds of copyright material, I’m in the clear! Reality: There are no precise numbers dictated under the fair use doctrine when it comes to how much of a copyrighted video or song you can use. Simply put, the amount that you use just needs to be reasonably related to your purpose.”> Seems like a core piece in the copyright puzzle is how much you - purposefully or not - threaten to <take away> sales (or views) from the original. Become a rivaling player on that market, so to speak. In fact, knowing the ropes on the Fair Use Doctrine is very important, as it is written into law specifically, and youtube or any other person or organization using its power without consideration taking out your videos at will are in turn violaters of the laws protecting freedom of expression, not just Ownership, under the Bill of Rights, ultimately, if it's U.S. law. | Aug-03-13 | | achieve: <But for Petrovs I think a more "continental" sound is in order.> You must have read my mind - the other day I realized how much of my musical vocab is derived from the american songbook, Gershwin, Porter, Berlin etc., and scoring Petrovs with material from Gershwin seemed a little off, to me, and, let's turn this into a question now, isn't it also a sort of tribute to the artist heritage to use music from composers or artists related to- or from- his home soil? Or - alternatively - if the location of a tournament is in South America, might it not be appropriate to use music from that area? This is the fun of creative freedom; there really are no rules writ in stone that must be obeyed; you just go with integrity for the objectives you aim to achieve. In fact material from Rachmaninoff, Scriabin, Prokofiev, Mussorgski etc., is mostly instrumental and universal in character, and it would be a great challenge to use that, as well. |

 | | WCC Editing Project: <Niels> the Aherns interview is a straight out, bald faced lie. It's for propaganda purposes only. In the youtube copyright strike system, which is entirely automated, "fair use laws" are a dead letter. They are simply ignored.
"Fair use laws" are also currently ignored in all internet and torrent site court cases decided so far. "Fair use" is not even mentioned in any of these court cases. <Blackbird> and millions more. Yep but this is no guarantee for me. First, the video may be blocked in one or many countries. Second, most of the time when you get the automated copyright strike on youtube, it says "Your video is still available world wide. Claimant may be entitled to any ad revenues from the video". But I used hundreds of music snippets so far, and over the course of a year or more the strikes piled up and around 15 percent of my videos were blocked in Germany, and even Germany and the US. I have access to very detailed information about my audience, and Germany is number 2 on the list for my chess documentary viewing audience. So for me, from now on the music I use has to be iron clad free: 100 years old and performed by someone who has licensed it for <creative commons>. That's <musopen.org> or an original artist (you, or Andrew). <Duration of Petrovs> : 40-45 minutes sounds about right? <Regional Music> Yes- and often this music is not patrolled by the copyright trawler on youtube. I have a large collection of Russian folk music, and also Indian/Pakistani folk music, that I have "test uploaded" to see if it gets any strikes. Most don't. I have an entire separate youtube channel to post "strike test videos." But I'm hesitant to use any of this regional music because copyright conditions on youtube frequently change quickly, and usually for the worse (for me). Bullet proof is what I want. |

For a sitar I need to buy a synth, and I might just buy a cheapish one, which I sorta was planning already. Can just put it on my dektop and play it there with my monitor close, and use a drumkit etc. - you can then literally play and simulate just about any sound. |

As you will notice at the end of the little 1 minute ditty, I hold the sustain pedal and the sound swells so much that it distorts, but this is easily mended, and adjusted for. Normally i don't use the other instrument options, which are rather limited, but the acoustic guitar sample is a bit sitar like, and the fast strings are nice as well, nothing too fancy. Back to work, other sample files are in the pipeline prior to release tomorrow. |

I will be recording my piano files with my actual acoustic in the future, which will result in a no doubt very natural balance, no dominant bass, if I place my mic correctly... No more keyboard for those tracks. Plus it's much more real and beautiful with regards to richness of the sound; only thing is to keep the background noise to a minimum. I'll record the other sample piano though, much thinner bass with that one, and then we can compare all three. |
