Perhaps White's resignation was in anticipation of 40...Qxh4, with an extra pawn and the threat of 41...Nf6 followed by 42...Ng4 or 42...Re8.

That said, I doubt that FM David H. Levin is right about White resigning in this game. The free Stockfish analyst evaluates the final position as -0.57, which is not resignation territory for sensible people. Levin's suggestion of 40....Qh4: looks like it asks for 41. Bg6:, which would need to be calculated. Many people would prefer preventing that at move 40.

White's position doesn't look great, but it doesn't look that bad either. And Dake wasn't known for resigning prematurely.

I agree that the possibility I put forward seems highly unlikely. It's unfortunate that there aren't more game scores that explicitly indicate time forfeit where that occurred.

May-22-24  Granny O Doul: Possibly Black actually overstepped, the arbiter forfeited White then asked whether Kennesaw Mountain Landis ever reversed a decision.
